BIRMINGHAM, Ala. (AP) - Fired HealthSouth Corp. CEO Richard Scrushy argued in court documents that the testimony of five former finance chiefs linking him to a huge fraud wasn't proof of a crime and asked a judge to bring an early end to his trial.
In a motion filed late Tuesday, Scrushy claimed prosecutors lacked the "key and essential element" for tying him to the scheme one document showing he knew of the $2.7 billion earnings overstatement at the rehabilitation and medical services chain.
U.S. District Judge Karon Bowdre scheduled a hearing for Thursday on the defense request, filed after prosecutors rested in Scrushy's trial.
