PROVIDENCE, R.I. (AP) - Rhode Island's Supreme Court ruled unanimously Monday that a lawsuit filed by a woman whose car was struck by a stolen flatbed tow truck being chased by police should be heard by a jury.
The decision reverses a lower-court ruling that threw out the lawsuit by Mary Seide, who was traveling home to Boston when the accident occurred. in continuing the chase even as the truck drove the wrong way down a busy interstate.
"The plaintiff produced evidence that reasonably could lead to the conclusion that the officers' decision to continue the pursuit and their failure to terminate the chase earlier, when they realized the danger it posed to themselves as well as innocent citizens, was in reckless disregard for the safety of others," the court said.
