RICHMOND, Va. (AP) - A federal judge on Tuesday denied the Justice Department's request for further discovery and a hearing in the patent case involving BlackBerry wireless e-mail service.
But U.S. District Judge James R. Spencer said the government can appear at a hearing later this week as he considers an injunction against on U.S. BlackBerry sales and service, as well as damages.
The case began in 2001, when tiny patent-holding company NTP Inc. sued BlackBerry maker Research In Motion Ltd. for patent infringement. A year later, a jury sided with NTP.
