RALEIGH, N.C. (AP) - A judge threw out a lawsuit Wednesday challenging the legality of a $300 million-plus incentives package that lured computer maker Dell Inc. to build a plant in North Carolina.
The case was filed by seven taxpayers who argued the state and U.S. constitutions prohibit tax breaks for individual companies because they harm the public and give the firm an unfair advantage.
Superior Court Judge Robert Hobgood read his ruling from the bench in a Wake County courtroom, said Pamela Cashwell, an attorney with the N.C. Institute of Constitutional Law, which represented the taxpayers in the case and confirmed the judge's decision. Hobgood's signed ruling was to be released later Wednesday, the judge's office said.
