ATLANTA (AP) - A judge on Friday refused to throw out kidnapping and carjacking charges against a man accused of killing a judge and three other people in a shooting rampage that began at the Atlanta courthouse.
Brian Nichols' lawyers had asked Superior Court Judge Hilton Fuller to declare the statutes covering the offenses of kidnapping and hijacking a motor vehicle unconstitutional. They argued in part that elements of the laws for those offenses in Georgia are vague and ambiguous.
Fuller rejected the arguments in separate orders.
