LITTLE ROCK, Ark. (AP) - An interim U.S. attorney says a "partisan circus" over his recess appointment makes it impossible for him to receive fair consideration, and he will not seek Senate confirmation to his Arkansas district.
However, Tim Griffin can remain at the post without confirmation under a new provision in the Patriot Act that allow recess appointments to last until the end of a president's term, instead of 120 days. That provision was included in the act's reauthorization last year.
The new rules became fuel for hearings when the Democratic-controlled Congress took power this year, with Sen. Mark Pryor, D-Ark., questioning Griffin's appointment.
