TAMPA, Fla. (AP) - A confession made in custody by the sex offender accused in the 2005 slaying of Sarah Michelle Lunde can't be used against him at trial because investigators didn't give him proper access to an attorney, a judge ruled Monday.
Other incriminating statements made by David Lee Onstott were kept in evidence by the Circuit Judge Ronald Ficarrotta, but the loss of the primary confession dealt a serious blow to prosecutors, who said they will immediately appeal the decision.
Ficarrotta postponed the trial, scheduled to begin March 12, pending the appeal.
