FORT BRAGG, N.C. (AP) - A military hearing opened Wednesday to determine whether a retired soldier acquitted in the 1980s of state murder charges should now face a court-martial in the same deaths.
Local prosecutors said newly available DNA tests link Master Sgt. Timothy B. Hennis to the slayings of an Air Force captain's wife and daughters, but they can't file new charges because of the constitutional protection against double jeopardy.
Instead, the Army charged him with murder and rape in November, two months after recalling him to active duty so it could investigate the case.
