FORT BRAGG, N.C. (AP) - Military prosecutors said Friday that a retired soldier should face his third capital murder trial for a 1985 triple murder because newly tested DNA evidence links him to the crime.
The request concluded an Article 32 hearing for Army Master Sgt. Timothy B. Hennis, who was acquitted in a civilian court nearly two decades ago for the rape and murder of an Air Force captain's wife and the murders of two of her daughters. Hennis was recalled to active duty last year so the Army could pursue new charges.
"The overwhelming evidence ... points to Master Sergeant Hennis as the perpetrator of these criminal acts," Capt. Matt Scott said during the hearing. The military prosecutor said Hennis should be considered for the death penalty.
