By ROBERT JABLON

This booking photo provided by the Los Angeles County Sheriff's Department shows Oscar-nominated actor Ryan O'Neal after he was arrested for investigation of assault with a deadly weapon and negligent discharge of a firearm during a brawl with his oldest son, on Feb. 3, 2007. Prosecutors declined Friday, May 25, 2007, to charge O'Neal , 66, citing insufficient evidence. (AP Photo/Los Angeles County Sheriff's Dept. )LOS ANGELES (AP) - Prosecutors declined Friday to charge Ryan O'Neal for firing what the actor called a warning shot during a brawl with his son this year.

Witnesses to the Feb. 3 shooting at O'Neal's home in Malibu — which injured no one — gave conflicting accounts to authorities, said Jane Robison, a spokeswoman for the district attorney's office. That left insufficient evidence to prove the case, she said.

"It's a tremendous relief for Mr. O'Neal to have this resolved favorably in this manner," said Mark Werksman, Ryan O'Neal's attorney.
