Ruling that overturned NJ murder conviction stands

Friday, July 03, 2009 2:48:44 PM

PHILADELPHIA (AP) - A federal appeals court will not reconsider its ruling that overturned a murder conviction.

In a decision announced Thursday, the 3rd U.S. Circuit Court of Appeals said it would deny the request made by the Ocean County Prosecutor's Office in New Jersey.

The appellate court decided May 28 to overturn Paul Kamienski's 1988 convictions and double life sentence in the murders of a Florida couple in 1983 in what prosecutors called a drug deal gone bad. The court wrote the evidence presented at trial was not sufficient to warrant the verdict of guilty beyond a reasonable doubt.
